Terms and Conditions
New customers will receive by e-mail a document detailing the Terms and conditions of the Archives, along with the fee rates for the requested uses. Terms and conditions are available on-line in several languages.

Before images can be sent the new customer will have to fax the following documentation to fax # +39 055 641124:
  • a signed copy of Scala's Terms and Conditions;
  • confirmation of the order on letter head paper specifying the name, address, telephone and fax numbers of the company, as well as the contact information for the billing department; VAT registration number for European Union members; a list of the images required, and the desired support (digital file or transparency); as well as the preferred methods of delivery.
The copyright fee quoted in the rate schedule includes the costs of scanning and colour correction of the transparencies, the lease of the transparencies/CD-ROMs, and the one-time, non-exclusive colour use for the specified time frame. The duration of the reproduction rights depends on the use requested, and is specified in the rate schedule. Re-uses will be charged at a discounted rate.

Scala images are protected by invisible watermarks, traceable on and off line.
Photographs and other images are protected by copyright laws, and their creators, as copyright holders, have the right to exercise control over their use. Anyone who violates copyright is subject to fines and destruction of the infringing work.
The copyright on the images belongs to the photographer (Scala) and, in some cases, to the artist and/or the owner (collector, museum etc.). As you purchase an image from Scala Archives you are granted a license, copyright clearance, from the photographer and in most cases the owner. Any authorization or surcharge to be settled with the owner, is always indicated on our delivery notes and in the image on-line detail.
The utilization of works by artists who are living or have been dead for less than 70 years, thus not yet in Public Domain, requires the additional authorization of the copyright holder or their Collecting Society (for example, DACS for the UK, ADAGP for France, BILDKUNST for Germany, VEGAP for Spain, VAGA or ARS for the United States etc.). Any authorization or surcharge to be settled with the artist, or the owner, is always indicated on our delivery notes and in the image on-line detail. In some cases copyright may also be held by additional third parties (for example Personalities Rights, such as Marilyn Monroe or Albert Einstein, or in the case of trademarks).
